A fatality involving the use of a telehandler has prompted a warning from the Health and Safety Executive to employers to ensure that these heavy equipments are used responsibly and for the purpose they are designed for. Several serious accidents involving the use of telehandlers have been reported in recent times.

In the most recent case of telehandler accident, Daylesford Organic Farms Limited was found to be at fault for neglecting to implement safe practices at its organic farm in Gloucestershire. The company is registered in Mondovia, Liberia. Investigations showed that a very negligent approach was taken towards safety practices at the farm.

The accident occurred in 2007 when employee Anthony Cripps was riding in the bucket of the telehandler with a colleague. The machine had been used as their work platform earlier that day. The men were collecting elderflowers during the harvest season for further processing. During the ride, Mr Cripps fell backwards out of his seat and came under the offside wheels of the machine. He was crushed to death instantly.

It was later revealed through investigations that the driver had not been adequately trained in handling the machine.

The legal proceedings took place at Gloucester Crown Court and were presided over by Judge William Hart. The company pleaded guilty to charges of breaching Section 2 (1) of the Health and Safety at Work etc. Act 1974. Judge Hart stated that the incident demonstrates that adequate risk assessment had not been taken by the company. The company agreed to pay a fine of £65,000 and costs of £27,500.

The financial implications of a disease among the workforce are very serious. It is reported that the UK spends seven billion pounds a year to provide treatment for muscle and joint pains, broadly known as musculoskeletal diseases. The budget of the European Union for the same is 240 billion pounds.

The number of workdays lost in the UK due to MSDs is 9.5 million a year. Out of the 100 million afflicted with this disease, 40 million are workers, and forty percent of these workers have been forced out of the workforce. These alarming facts are contained in a report presented by The Work Foundation. This research organisation covered twenty- five European countries to get a real picture of the prevalence of musculoskeletal disease in Europe.

An unfortunate incident in Wiltshire where a worker using a top cutting machine got fatally injured by its rotating drum last month has prompted HSE to issue safety alerts on such machines that cost workers their lives.

The HSE has urged the construction industry to create more awareness of the possible risks that such machines pose in the absence of proper safety devices. Speaking further on the role of the utilities and construction industry, HSE inspector Helena Tinton said that the only way such incidents can be checked is by getting companies to install proper safety devices on top cutting machines.

With the joint investigation on the case by HSE and the Wiltshire police still in progress, authorities are not ready to comment on the incident at this stage. However, Tinton is critical of the callousness of employers who fail to provide safely functioning equipment to their workers, stating that employers are legally bound to provide machines that are properly maintained and preserved apart from being fully tested for safety on all levels.

She further cautioned that machines of this nature are normally equipped with an automatic system that turns off the power automatically once the driver’s seat on the machine is vacated. Yet to be doubly safe, all repair work on the cutting wheel must be carried out only after the power has been physically disconnected and the machine is completely disabled.
