A short-covering rally is a more orderly event in which a large number of short sellers decide to take profits by covering their positions. The buying to cover often leads to more buying. It can produce a wild short squeeze, but in most cases the action is milder.

You’ll see a short-covering rally in many beaten-down stocks. The greatest impact, though, is seen when the DOW or NASDAQ moves higher as loads of shorts head for cover.

For example, the market rally that preceded the US attack on Iraq was almost certainly a short-covering rally. The DOW and NASDAQ had been sliding since late January and were approaching new lows. Short sellers had made outstanding profits.

Then a few early-bird buyers stepped in to spark a big open on March 17. The shorts took that market strength as a cue to cover some positions and lock in profits. As more and more shorts bought shares to cover, the DOW and NASDAQ surged higher, attracting a horde of buyers who did not want to miss the move.

A typical short-covering rally occurs in the final hour of a market session. If bad news or some other development hits the indexes at the open, short-sellers often hop on the downward momentum and push prices lower. By 3 p.m. ET the DOW could be down 100-plus points.

More often than not, the indexes will stage a comeback in that final hour. Short sellers who have made a tidy one-day profit cover their positions, and that usually produces a spurt of buying. It tends to fizzle out in the last few minutes before the close when the momentum players are out and outright sellers again take control.

Day traders and other savvy investors look for signs of a late-day short-covering rally as an opportunity to grab some index-tracking Exchange Traded Funds (ETFs) like the DOW “Diamonds” (symbol DIA) or the NASDAQ ‘Qubes” (symbol QQQ), or some “e-mini” futures contacts on the S&P 500. If the rally runs true to form, the momentum players are out before the closing bell, and hoping a few bucks richer.

You, too, should keep an eye out for short-covering rallies when you’re looking to buy or sell stock. They can be helpful in timing your order.

It seems completely absurd that franchise buyers lie about their financial position, available cash and abilities in order to buy a franchise. After spending 8 years setting up franchises around the nation and fielding inquiries I am appalled at the lack of integrity of the average business buyer. If you wonder why franchisors make franchise buyers fill out forms and ask lots of questions it is because 75% or more of every franchise inquiry to a franchise company is misrepresentative of their reality. A franchise opportunity seller should beware of franchise buyers lying on forms.

Why do we have laws for franchise companies and yet none for franchise buyers or investors? It is appalling the lack of integrity of the average American or in this case investor of a franchise. Some of these liars waste our valuable time as the fraudulently make up a falsehood picture of their financial ability and business acumen. They ought to be thrown in jail.

Well, I guess I really went off on the franchise buyers. At the time of this statement in 1999 I had just hung up on four franchise buyers that week, feeling it hopeless to even have further conversations with anyone inquiring. Turned out not all these potential franchise candidates or buyers were real, many were competitors and even some believe it or not were working for the government as entrapment phone solicitors. One we later got to know was a 26-year old homosexual Attorney working for the Federal Trade Commission, who upon my visit to the FTC office in Washington DC, starred at my rear end the entire time?

We franchisors work very hard and can usually help a franchisee into a very small business of their own position, but we need straight answers; such as their true financial picture. If we get a song and a dance about how much money they have, and then we start the process only to find out that they really do not have as much as they said then we have a franchisee who may fail simply due to being under capitalized.

The most common reason small businesses fail as surveyed time and time again by the SBA; Small Business Administration and other groups is the fact that the business was under captialized. If we have franchise buyers who want colorful brochures, great, but level with us. Tell us you just want someone to tell you, you are great and you just want someone to yell at due to your personal frustrations. If you have little money state that, there maybe a plan to help you along. Then after that is over we can be serious about winning market share and having all the game plan laid out carefully. I doubt if the US Military wants to fight a war with generals who do not have bad information, pilots who do not follow orders, Navy Seal Teams who are untrained, an intelligence agency who lies or allies who are actually hostile and full of misinformation. To win a war in franchising you must above all be on the same team, from the beginning. It is imperative that every one understands each other’s goals to win.

Franchise buyers who want to be argumentative towards their future business partner in order to vent off anger from their previous downsizing company and tyrant boss should wait until they are better understanding of their current situation and ready to review why they are where they are, before they try to buy a franchise. A franchisor that puts up with such non-sense has no business franchising, because that franchisor is clearly out for just the money and that short term attitude will kill the long term win-win partnership that is needed to dominate the market place. A franchisor such as that should not be in the franchising business. Franchisees who lie from the start are not good team members and once that bond of integrity is broken there can be no more trust. Advice; if you are going to buy a franchise, be upfront and honest with your future business partners, you moron. Think about it.

Everyday, from municipal legislative chamber to the general assembly of the United Nations, legal arguments are heard. However, no matter how the legislative members are educated and committed to community well-being, law is not definitively “just”. A law adopted by the legislative body would bring hardship to the executive and judicial bodies and vice versa (conflict of law).

That’s unjust and unfair? Expressed by the election losers or those who fail to gain the benefits in any condition. Law is not perfect, it would bring more injustice. Municipal law would also extend the gap between the rich and the poor, international law adopted by the general assembly of the United Nations would also bring imbalance of economic and other social powers, between two neighboring countries or even countries in different continent: trade-sanction-imposition applied by the United States of America (North America) would hurt one or countries in Asian or Latin American continents.

From the above merits, Law is extensively seen in the negative aspect. But why law is still invaluable to the municipal and global society? This article intends to bring some unique advantages brought to all of us only by “law.”

Of course, conflict of law would bring political unrest between two or more groups or between the government and its citizens, but no country, even the world’s most primitive tribal group also needs law (rules) to general its daily formal and informal conducts. So what are the advantages of rules?

First of all, rules systematize any conduct. No matter whether that conduct would affect just one or two people, the whole society or even the world. The term “systematize” here refers to the generalization of conduct. The term “generalize and systematize” in this article are the same. When any conduct becomes generalized, it will be easy to remember and to follow and, to a more positive extent, commission of any conduct that is not generalized would bring mental unease and guilty sentiment to the committer.

Let’s me bring a very simple example: why do we need rules in an organization? Why family needs family rules and government needs government’s rules? One of the most concrete and legitimate reasons is to systematize, in other word, generalize the conduct within the family, organization or government. Without rules to systematize (generalize) the within conduct, members of family, organization or government would do think differently from one day to another, and this would lead to the loss of family’s, organization’s or government’s identities, and repercussion is clear: break-up.

Secondly, rules make thing more just. I say making thing more just, because there is no genuine justice in this world. Why make thing more just? When rules apply to everyone within the group, the group members are obliged to abide by it and anyone break the rules would be sanctioned to penalties set fourth in the rules. Yes, there is no genuine justice in this world, but if punishment is equally applies to me as to you, this would make you and me feel more just. Injustice would become justice when everyone consorts to that injustice: a rule never taught in law or general schools, but I tell you now.

Thirdly, rules convert you to be “a strict person.” The word “strict person” means the those who is respectful of the rules or law. In this sentence, the word rules and law are the same.

The word attorney can, nowadays, tend to conjure up glossy images of a smart-suited person either prosecuting or defending someone in a court of law depicted television style, using every means possible and a few more, to plead the case for or against a defendant in a dramatic court case.

This to me is an indication of the populist view of the legal profession, portrayed for the benefit of worldwide audiences on our movie or television screens. The glamour part of the profession is painted on quite thickly to engender the romantic notion of a type of hero worship and aloofness for the legally-trained orators.

One thing I am sure that is often forgotten is that these people have the power to take the liberty from somebody in the dock on that day. I don’t think that is wrong incidentally, it’s just that we have to accept that our society appoints an attorney to protect us in the long-term from potentially dangerous criminals. We also have to remember that if an attorney is for example defending in a murder trial, he can only defend to the best of his ability with the evidence that is given. After all, the jury are the people who have the final say in these matters – and quite right to!.

Cynical I may be, but we if we are called to give evidence in a trial we take an oath or affirmation to tell the truth and, in this hypothetical case, we also presume that everyone else is telling the truth. We don’t hear of many perjury cases nowadays and yet there have to be lies told in every case that comes to court!

The word attorney, I feel, is a general term, depending on what part of the world you live in. I suppose, and as this is only my opinion, an attorney may be a solicitor, lawyer or barrister, depending on which part of the world you live and how you view the legal profession.

I find, as a lay person, the American legal system quite interesting. We hear expressions like District Attorney, State Attorney and other titles. I am guessing that these apply to various levels of legal practice, reliant on how people expand their knowledge and climb up the legal ladder. Attorney-General, I presume in the United States, would be the same say as the Lord Chief Justice in the United Kingdom. They would be in fact “the main man” – just a comparative term by the way, not in any way meant to be sexist or discriminatory.

Like any major profession, the wait to reach the heady heights of a courtroom battle is probably only open to a few more elite and more intelligent people, who have studied extensively and excessively to complete their chosen career path.

It is more likely that the attorney the general public would be dealing with on an every day basis, would be if we have some minor disagreement that needs a professional opinion on their specialist topics, whether it be house purchase, family law, patent laws and scores of other topics that perhaps don’t need the grand legal venue of a courtroom.

One thing that is for sure. An attorney plays a vital role in the democratic system. We rely heavily on being able to find justice for all in the way we live. Long may they prosper!

Bum Glue is the term I give to describe refined and processed grains. Do you remember at school, we used to make glue out of white flour and water? Remember how it smelled after a few hours and how it set like cement when you used it? Well, that same cement-like action is happening inside your body every time you eat white breads, pasta and rice. And after it has been in there for a while, it becomes foul, sticking to the walls of your bowel and sucking the life out of you. I call it ‘bum glue’.

Ideally, you should avoid grains that have had the wheatgerm removed, which is what white bread is. The germ is where most of the nutrients live. Refined and processed grains are acid-forming (high in phosphorous) and when consumed as flour, tend to cause problems in the gut (such as bloating), the brain and the joint capsules. Refined grains are also very high in phytates, which latch onto water-soluble nutrients including vitamins B and C and minerals such as calcium, chromium and magnesium. So while you could be eating what appears to be a healthy sandwich containing meat and salad on white bread, the reality is that you are not going to absorb the essential nutrients because the refined grains leech the goodness away. If you did nothing other than replace white grains with brown in your diet, your basic level of health would increase dramatically.

Most commercial wholegrain breads are made with a white wheat base and most of the supermarket rye breads, in particular light rye, are made with only about nine per cent rye flour, the remainder is primarily refined white flour. Learn to read the packaging of the foods you buy, and learn to look for hidden ingredients. Biscuits are a classic food, which is based on white flour 99 per cent of the time. There are some brands nowadays that are making wholemeal varieties, which are a much better alternative. Anything that you bake or buy that contains white flour can be also made using wholemeal flour, which cooks just the same, tastes great and won’t glue up your body as much as white flour will.

Psyllium Husks – The unclogger

So what do you do when you realise that you have may have a little ‘bum glue’ stuck from years of eating refined white grains? The solution is easy. There is a grain called psyllium, it is the size of a sesame seed and you can buy the husks in the health food section of the supermarket or from the health food store. It is a wonderful raw fibre that has no taste. Psyllium makes poo bulkier, so that you can scratch off some of that gluey residue that has built up. The easiest way to take psyllium is to add two dessertspoons of the husks to a glass of juice in the morning, stir it in quickly and drink. If you let it sit in the glass it will get very thick and be very unpleasant to drink, so drink it down immediately. It has the consistency of a glass of orange juice with the pulp in it and no added taste.

In my clinic I would often see parents with kids and poo challenges as well. One of the suggestions I would give them was to make jelly for the kids by adding some psyllium husks to a cup of their favourite fruit juice and setting it in the fridge. When the kids then eat the jelly it helps to keep them regular and to clean their digestive system at the same time. Check with your naturopath before giving psyllium to your child.

_ Important note: When adding psyllium husks to your diet always make sure you are drinking your daily quota of water, the psyllium needs water to help create bulk and move the gluey bits.

Today’s people are eating hundreds of kilograms of refined white flour, white rice and sucrose every year, and that’s enough processed high-glycemic carbohydrate to destroy anyone’s insulin metabolism. High-glycemic carbohydrates are refined and processed foods that cause the body’s blood sugar to rise too fast, resulting in the body over reacting. Google Inc. has launched a new software package that allows you to see satellite images on your desktop.

Google Earth lets you search for locations anywhere on earth and display 3D aerial images of major cities and tourist attractions. Google Earth is in development, but a free beta version is available for home users. Locations can be searched by address, intersections, cities, zip codes or countries and the images can be zoomed in close enough to see streets and buildings.

The images generated are 3D – you can rotate the view to see different sides of an object. You can navigate using a mouse or the keyboard, and view selectable layers to display information about local features such as roads, terrain, schools or golf courses.

Images of 38 US cities can be viewed from “the ground up” allowing you to see 3D representations of buildings and terrain. Measurement functions include distances between two locations, perimeters, radius and area.

Search results can be saved, printed and emailed. Driving directions can be automatically generated and you can trace the route using the “Play” button located underneath the directions tab.

Google Earth is based on technology from Keyhole Corp., a digital mapping company acquired by Google in 2004. The database that drives Google Earth is based on images from satellite and airplane photographs. The database is said to be “multi-terabytes” in size.

Google Earth is available in several versions. The free version is for personal use. Google Earth Plus costs $20 and integrates data from your GPS device. Google Earth Pro costs $400 and is designed for businesses who need a research and collaboration tool. Finally, there is Google Earth Enterprise Solutions for on-site deployment of Google Earth.

The technology behind Google Earth is not new, and smaller companies such as GlobeXplorer LLC have been offering 3D aerial views for several years. Google has the marketing clout, however, to bring the technology to the consumer level and integrate it into its advertising programs.

Users can search for local businesses and receive a viewpoint of 10 search results within a specified area. Clicking on a business listing brings up its address, phone number and driving directions.
